Miami Beach - Car Slams into Victim at Bus Stop - Miami Personal Injury Attorney Discusses
July 28, 2014
A 31 year old Miami Beach man is seriously hurt while waiting for the bus when a car slamed into a bus stop. A witness reported that at the scene of the incident the victim was bleeding from his eyes, ears and head. The accident happened at approximately 6:30 a.m. Sunday morning on 71st Street. The victim was hit by a silver Honda. Fortunately, the individual who was driving the silver Honda stayed at the scene of the incident and was interviewed by the police.
The circumstances surrounding this car accident are still being investigated by the police department. There are many questions that still remain like: 1) Why did the car veer off the road?; 2) Should the city or county have put up bollards around the bus stop; 3) Was the driver distracted by texting?; 4) Was there proper lighting; 5) Was the driver speeding?; 6) Does the driver carry insurance - enough to cover the harm he caused.
The National Highway Traffic Safety Association (NHSTA) estimated that in 2010 approximately 4,280 pedestrians were killed and an estimated 70,000 pedestrians were injured in car accidents. This case is different from other pedestrian versus car accidents in that the victim was not attempting to cross the street and was not even on the sidewalk. There is obviously little to no argument for the victim's comparative fault. Hopefully, the silver honda's driver had sufficient insurance to cover the damages and injuries he caused this innocent victim.
